By using, browsing and booking via this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy and website disclaimer, govern Cavalier Cruises/Sunshine Coast Afloat’s relationship with you in relation to any and all bookings made by yourself with Cavalier Cruises/Sunshine Coast Afloat.

For the purposes of these Terms and Conditions, “Cavalier Cruises/Sunshine Coast Afloat”,“Us”, “Our” and “We” refers to Cavalier Cruises and Sunshine Coast Afloat and our websites sunshinecoastafloat.com.au, coastlinecruises.com.au, fishncrabcharters.com.au, cavaliercruises.com.au and any other domain names registered to the parent company and linked back to sunshinecoastafloat.com.au,  while, “You” and “Your” refers to you, the client, visitor, website user or person using any of our websites.

 We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. If you choose to use our website or make a booking with Cavalier Cruises/Sunshine Coast Afloat via an alternative method such as phone, email or SMS, then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and Cavalier Cruises/Sunshine Coast Afloat’s rights and obligations to each other. This relationship will be confirmed in writing via the email sent to you the customer via the booking system utilised by Cavalier Cruises/Sunshine Coast Afloat and be delivered by email, SMS or standard mail to you the customer.

LIMITATION OF LIABILITY

By using our website that you fully agree and accept that Cavalier Cruises/Sunshine Coast Afloat cannot be legally held responsible for any loss or damage you might suffer related to your use of any of our websites, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the websites. This includes your use or reliance on any third-party content, links, comments or advertisements. Your use of, or reliance on, any information or materials on websites owned and operated by Cavalier Cruises/Sunshine Coast Afloat is entirely at your own risk in each and every respect.

It shall be your own responsibility to ensure that any products, services or information available through any of the websites owned and operated by Cavalier Cruises/Sunshine Coast Afloat meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

COMPETITION AND CONSUMER ACT

For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), Cavalier Cruises/Sunshine Coast Afloat’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again.

You must be over 18 years of age to use this website and to purchase any goods or services.

All terms and conditions apply equally to Gift-Vouchers as well as bookings unless expressly stated differently.

1. GENERAL TERMS:

  1. All charters and cruises are operated by Fish n Fun pty ltd as trustee for the VDV Family trust, operating as Sunshine Coast Afloat as well as Cavalier Cruises.
  2. These terms and conditions will also be emailed to you together with your booking confirmation.
  3. Cavalier Cruises, Sunshine Coast Afloat, it’s employees or associated companies will not be held responsible for any personal injuries, equipment loss or damage sustained whilst engaged in any activities, including boarding and disembarking any vessel or craft, with Cavalier Cruises/Sunshine Coast Afloat. While Cavalier Cruises/Sunshine Coast Afloat make every effort to safeguard clients they would like to advise that; all water activities include risk, and all activities on board or off board are at individuals own risk. The company, directors and staff accept no responsibility or liability for any loss, accident or injury to persons or property.
  4. All Passengers that participate in any activity offered by Cavalier Cruises/Sunshine Coast Afloat acknowledge that they do so at their own risk, and in no circumstance will Cavalier Cruises/Sunshine Coast Afloat, its officers, servants, or agents be held responsible for any accident, injury, loss or damage to person, valuables or property whilst embarking, travelling or any other activities on board, or disembarking from Cavalier Cruises/Sunshine Coast Afloat operated vessels or crafts.
  5. To ensure all passengers have been informed of, and acknowledge the terms and conditions, all passengers are required to complete a Release of Liability/Assumption of Risk form prior to departure.
  6. This Release of Liability/Assumption of Risk incorporates the the following parts;
    1. Qld Heath required components as required for the management of the Covid-19 Pandemic tracing.
    2. The same requirement exists for all licensed liquor venues including vessel such as Crusader 1.
    3. The Release of Liability/Assumption of Risk also forms part of Sunshine Coast Afloat’s passenger verification documentation as required by AMSA.
    4. Cavalier Cruises/Sunshine Coast Afloat reserves the right to use the information in the form to complete our customer database. You may receive emailed marketing material which will have a functional “opt out” should you not wish to receive such.
  7. Your information will not be passed on to any other bodies other than Qld Health and AMSA upon their request for such.

  9. The signing of this Release of Liability/Assumption of Risk can take place prior to boarding the vessel by use of the displayed QR Code, or up to 24 hours prior by use of the link to the form that is sent with the final confirmation.
  10. Any passenger that refuses to complete the Release of Liability/Assumption of Risk form will be refused admission to and participation in the activity booked, and no refunds will be deemed applicable or provided in such cases.
  11. As we legally cannot depart until EVERYONE has properly checked in via the form, and options for early check-in are available, delays brought on by missing entries may result in passengers missing the departure, or in the case of private boat bookings, in delays of departure. Neither will be considered acceptable reasons for refunds, discounts or later return times.
  12. Passengers with any back, neck, shoulder or heart conditions, or those who are pregnant or who have injuries/conditions that may cause a risk to their health are not permitted to participate in the activities, and if so, do so at their own risk. All activities are suitable for persons with normal health and fitness.
  13. All passengers must meet the minimum age of 7 years.
  14. Children aged 13 years and under must be accompanied by an adult.
  15. Adult company is recommended for any passenger between the ages of 14 and 18.
  16. Should you have any concerns with motion sickness please consult a chemist.
  17. Cavalier Cruises/Sunshine Coast Afloat reserves the right to refuse service to those who are believed to be affected by alcohol or drugs and no refund will be provided in such cases.
  18. There is no BYO on our individual ticketed cruises, drinks may be purchased on board.  Cash & card accepted
  19. Cavalier Cruises/Sunshine Coast Afloat has the right to refuse any passengers for any reason.
  20. Drugs or illegal substances are NOT permitted on the vessel at any time. 
  21. The wearing of shoes is not permitted aboard the vessel. In the case of Weddings only, Cavalier Cruises/Sunshine Coast Afloat may, at its sole discretion, allow shoes under certain circumstances when combined with the use of heel protectors. 
  22. Clients must be at the departure location at least 20 minutes prior to boarding. This to allow for boarding and safety briefing without impacting on the actual activity duration. Cavalier Cruises/Sunshine Coast Afloat is not responsible for any delays caused by the late arrivals of members.
  23. Minimum Passengers numbers are required for the various tours:
    1. A minimum of 15 full fare, non-commissioned, passengers are required for any party cruise to be able to proceed.
    2. A minimum of 10 full fare, non-commissioned, passengers are required for any Whale Watching tour to be able to proceed.
    3. A minimum of 25 full fare, non-commissioned, passengers are required for any Christmas Lights cruise to be able to proceed.
    4. A minimum of 4 full fare, non-commissioned, passengers are required for any Champagne cruise to be able to proceed.
  24. We will confirm the weather conditions, passenger numbers and if the activity is proceeding or not on the evening prior to the departure time.
  25. In the event of bad weather forcing the cancellation of a booked activity prior to departure you may re-book at your convenience, or obtain a voucher to return at a later date. With the exception of Gift voucher bookings, a refund is also available should an alternative booking date not be viable.
  26. In the event of a last minute cancellation by a group or party, forcing the cancellation of a booked activity due to the minimum passenger number level no longer being met, you may re-book at your convenience, or obtain a voucher to return at a later date. With the exception of Gift voucher bookings, a refund is also available should an alternative booking date not be viable.
  27. If an activity is cut short of time due to unexpected weather conditions, mechanical problems, or other influences outside the control of Cavalier Cruises/Sunshine Coast Afloat, it is at the sole discretion of Cavalier Cruises/Sunshine Coast Afloat to determine if any part refund or assistance is warranted. Sea Sickness and a lack of whale sightings are not valid reasons for any form of refund, and such requests will not be considered under any circumstances.
  28. Passengers may be filmed/photographed during any tour. Cavalier Cruises/Sunshine Coast Afloat reserves the right to reproduce such film/photos for any purpose whatsoever without notification, compensation or payment. Passengers acknowledge that such use may be via social media sites.
  29. Cavalier Cruises/Sunshine Coast Afloat reserves the right to alter the departure time and departure point as and when required.
  30. Cavalier Cruises/Sunshine Coast Afloat reserves the right to add, withdraw, substitute and/or vary advertised routes, prices and departure times at any time. The operator reserves the right to refuse entry, substitute the vessel and change the day’s itinerary without notice.
  31. All details are correct at time of printing/publishing and are subject to change without notice.

2. PAYMENT & CANCELLATION TERMS:

  1. Payment of a deposit, or in full, constitutes a confirmed booking and acceptance of these terms and conditions, by the person paying such amount.
  2. All quotes and prices on this website are in Australian Dollars and include GST.
  3. Groups are considered as 3 or more passengers.
  4. Large Groups are considered as 7 or more passengers.
  5. Full vessel bookings are considered as any number of passengers who as a group purchase the vessel for an exclusive ride upon which no other passengers are able or allowed to purchase tickets. In effect such groups purchase a maximum number of tickets in total for the activity.
  6. To secure any booking the total amount as payment is required. This is to be paid by credit card or EFT (Electronic Funds Transfer). If you are unable to pay the total, Cavalier Cruises/Sunshine Coast Afloat may, at it’s discretion, adjust your deposit to 50% of the total for a period outlined at the time. The balance to complete the entire amount due for the booking can be paid via cash or direct deposit into our account.  All prices include taxes.
  7. Any payments by direct deposit into our account must be made a minimum of a full 3 weeks prior to the date of departure. If such payments have not shown in the account by such time the payment will be deemed to be not made and the booking will be offered to other passengers. Cavalier Cruises and Sunshine Coast Afloat are under no obligation to contact the person that has made the booking to advise them of such.
  8. Cavalier Cruises/Sunshine Coast Afloat operates in an outdoor / offshore marine environment. Trips may change or be cancelled due to weather conditions. We still operate if it is raining and such rain does not adversely impact on visibility. Cavalier Cruises/Sunshine Coast Afloat reserves the right to cancel services due to inclement weather (generally defined as heavy precipitation creating visibility issues, extreme wind and extreme swell conditions, determined as dangerous by Cavalier Cruises/Sunshine Coast Afloat). Such determination is not subject to passenger input. In the event this occurs rescheduling to an alternative date will be organised for a convenient time.
  9. All cancellations MUST be informed by the person that made the booking IN WRITING to Cavalier Cruises/Sunshine Coast Afloat within the timeframes laid out in these terms. Phone discussions or face to face discussions without written proof or confirmation are not acceptable as there is no clear evidence of a cancelation actually being requested or required. No Refunds will be considered for any cancellations that are not supported by such written evidence. A reduction in passenger numbers – for a private booking or a group booking – is treated in the same manner as a cancelation. See section 3.9 of these terms and conditions for a more detailed timeframe on this area. 
  10. All tickets for activities which are considered able to proceed (including all types of gift certificates) are non-refundable.
  11. All bookings must be paid in full at least 24 hours in advance and are non-refundable within 72 hours for individuals, and in accordance with the group booking and cancellation policy below for groups and boat bookings, of the pre-booked activity time unless such charter or cruise is canceled by Cavalier Cruises/Sunshine Coast Afloat.
  12. From the 3rd week of November, through the entire month of December, including the Christmas Lights cruises and the New Years Eve Cruise, NO CANCELLATIONS will be accepted under any circumstance. (see also  point 3.9 in Group Bookings & Overnight charters – additional conditions). This due to the high volume of pre bookings made through September, October and November for this period. This advance booking period for the key Christmas holiday period generally makes it near impossible to replace any late cancellations, especially during the month of December. In this case, the term cancellations includes any reduction in the number of passengers originally booked for as well as the largest number of passengers booked at a later date if that number is greater.
  13. Any cancellations or ‘no shows’ (booked passengers running late or not showing up regardless of the reasons) made outside these terms and conditions will incur a 100% cancellation fee, inclusive of Gift Certificate bookings, and such tickets will be considered forfeited by passengers. No Refunds will be considered for these cancellations.
  14. No amounts are refundable if the required notice period is not given. Gift-vouchers are considered to have been redeemed in full should the applicable notice not be provided.
  15. Same day bookings are non-refundable. If cash payment at wharf on day of service is the chosen method of payment a credit card number must be provided to secure such a booking.  Sunshine Coast Afloat charge the full fee to the credit card supplied by method of pre-payment to ensure the information provided is valid and correct. Such a fee will not actually be deducted by the relevant credit authority unless payment on the day has not been received.
  16. All individual cancellations, including Gift Certificate Bookings, must be received 3 full days (72 hours) or more prior to the departure date and time.
  17. In cases where a booking has been made and confirmed, and you the customer cancels or changes the booking, Cavalier Cruises/Sunshine Coast Afloat has the the right to charge a $50.00 (fifty dollars) administration fee.

3. GROUP BOOKINGS & OVERNIGHT CHARTER PASSENGERS – ADDITIONAL CONDITIONS:

For group bookings of greater than 3 passengers, payment is required in the following manner:

    1. The person that has contacted Cavalier Cruises/Sunshine Coast Afloat and pays the deposit  – from here indicated as the group organiser – takes full responsibility of the booking.
    2. The group organiser must supply a deposit of at least 50% to secure the booking. This payment can be made by credit card or direct deposit.
      1. The booking is not secured until the deposit has been received by Cavalier Cruises/Sunshine Coast Afloat.  If the deposit has not been received within the given period, we reserve the right to allocate the vessel to another client.
    3. The group organiser is required to supply payment of any remaining balance still outstanding for the booking 2 weeks (10 working days) prior to the charter date booked.
    4. The group organiser agrees that they are aware that as Cavalier Cruises/Sunshine Coast Afloat will not be able to take any further bookings to cover/replace the number of passengers you have committed to at the time of booking, the total balance will be charged to the group organiser’s credit card in the case any or all of the group/party not show on the day, or should insufficient cancellation notice not be provided to Cavalier Cruises/Sunshine Coast Afloat.
    5. In all cases of a group booking, all discussions relating to any financial aspect will be with the group organiser. Other individuals within the group have no status financially with Cavalier Cruises/Sunshine Coast Afloat as there is no record of financial dealings with anyone else within the group.
    6. The operator reserves the right to berth the vessel at the destination point up to 10 minutes prior to the scheduled time to allow for disembarking.
    7. If necessary, any music or other entertainment may be ceased whilst returning to dock.
    8. Full balance of payment is required for full vessel bookings 14 days prior to the departure date.
    9. No refund is given if the actual number of guests is less than the minimum guaranteed passengers or final number of guests advised to us by the organiser of the booking. Reductions in the passenger numbers cannot be made 14 days prior to the departure date. As per item 2.12 above, reductions to the booked number of passengers from the 3rd week of November and through the entire month of December, will not be refunded under any circumstance.
    10. If booking a cruise utilising our bar facilities, no BYO alcohol or drinks are to be bought on board.  The cruise will be immediately terminated if any patron is found to have brought alcohol on board.
    11. All large group bookings (7 or more persons) require a minimum 14 days notice to be eligible for a refund.
    12. All other group (3 to 6 persons), and any bookings for an 18 hour (overnight) fishing charter, require a minimum 7 days notice to be eligible for a refund.
    13. Special offers cannot be combined in any manner.

4. DAMAGE AND/OR MISBEHAVIOUR

Any passengers doing any of the following actions as listed in this section will without exception be reported to the Australian Maritime Safety Authority (AMSA) and the Queensland Police Service (QPS). Actions of this sort will be recorded as a Marine Incident with persons liable for on the spot fines of up to $2200.

In addition Cavalier Cruises/Sunshine Coast Afloat may, if it feels it is warranted, insist on a security deposit – minimum of $500.00 (five hundred dollars) – should management feel the booking has the potential or risk for disorderly behaviour. This security deposit will be refunded the first weekday following the completion of the booking if no incidents requiring the use and loss by the customer of the security deposit have occurred. The minimum charge for any damage, or excess clean up, required by Cavalier Cruises/Sunshine Coast Afloat is a minimum of $500.00 (Five hundred Dollars). As this is never a comfortable consequence for either party we strongly request all guests behave and respect our vessels and belongings.

  • Causing any form of damage to the vessel or its fittings and equipment.
  • Endangering the vessel, crew or passengers in any manner considered unsafe by the skipper of the vessel.
  • Doing drugs aboard.
  • Jumping off the vessel – underway or whilst moored.
  • Urinating off the side bow or rear of the vessel.
  • Throwing rubbish or debris from the vessel into the water, onto another vessel or onto a pontoon or property.
  • Yelling at patrons on docks, other vessels and properties along the waters
  • Fighting or aggressive arguments regardless of whom this is directed at.
  • Swinging from or standing on the handrails.

4.1. DAMAGE AND/OR MISBEHAVIOUR ACTIONS

    1. Financially all damage to our vessel or contents is the responsibility of the person that has booked the activity.
    2. All incidents that occur during any cruise, charter or other activity are logged by the vessel master in the vessel’s daily log. 
    3. Where no security deposit has been obtained, any person or group that has caused damage to the vessel(s), equipment or other guests belongings, will be asked to pay for it on the day of the cruise prior to the vessel being berthed. If the cost of the damage cannot be obtained at the time the Mooloolaba police will be contacted with the request of meeting the vessel upon berthing. Please note that, regardless of the person having conducted the action(s), the person who booked the cruise will be held responsible to the payment of all and any damage.
    4. Any person or group deemed to be misbehaving or unruly will be cautioned only once by our crew. any continuation of the behaviour will force the immediate termination of the activity. The vessel will immediately return to the departure point and all guests will be removed from the vessel(s) with no refunds applicable or given.
    5. Any person or group starting physical violence to each any other person, including our crew will be handled by police who will in such cases waiting at the departure point on the return of the vessel. All commercial marine operators on the Sunshine Coast have a strong reputable relationship with the Mooloolaba police and they take our complaints very seriously.

5. RESPONSIBLE SERVICE OF ALCOHOL (RSA):

  1. Crusader 1 is a licensed venue and as such we cannot permit unduly intoxicated people to enter the premises (board the vessel). If you are intoxicated prior to boarding you will be unable to board the vessel. If you become unduly intoxicated whilst on board the vessel may stop at the safest available pontoon and require you to disembark.
  2. We are about having great fun on Crusader 1 and encourage sensible drinking through the responsible service of alcohol.
  3. We reserve the right to refuse service of alcohol even if the beverages are pre-purchased.
  4. Bar staff have a legal responsibility to refuse service of alcohol to people who are considered by them to be unduly intoxicated.
  5. A Cruise will be terminated if any patron is found to have brought alcohol on board.
  6. All guests may be asked to produce identification prior to purchase or consumption of any alcohol.
  7. Unruly, quarrelsome or disorderly patrons will not be permitted on board or tolerated throughout the cruise.  The situation will be referred to the organiser of the event but if continues will be escalated to the skipper who will in turn terminate the charter and return to the dock.  He will make the decision on calling the police.
  8. Any costs associated due to misbehaviour or misconduct must be paid by the organiser of the charter.
  9. The safety of our patrons and staff our our utmost priority.

6. REFUNDS:

  1. Refunds are offered and applicable ONLY in the following circumstances:
    1. Cancellations by Cavalier Cruises/Sunshine Coast Afloat due to weather, lack of passenger numbers, or other circumstances requiring the charter to be cancelled by Cavalier Cruises/Sunshine Coast Afloat.
    2. Cancellations by customers, that have booked directly with Cavalier Cruises/Sunshine Coast Afloat, and cancelled their booking with sufficient notice as per section 2 of these terms and conditions.
  2. All persons booking any trip with Cavalier Cruises/Sunshine Coast Afloat acknowledge that if electing to pay all or part of the deposit and or total amount by way of credit card, that bank fees associated with such payments cannot and will not be refunded. (1.8% of the amount paid in general).
  3. All refunds for bookings made via a 3rd party or agent must be requested via the 3rd party or agent. Refunds for such booking will not be paid directly by Cavalier Cruises/Sunshine Coast Afloat as it does not allow for commissions and could be misused by parties to defraud Cavalier Cruises/Sunshine Coast Afloat and the 3rd party or agent.
  4. All persons booking acknowledge they understand and agree that sea-sickness on any activity, or a trip shortened in time due to weather or other reason outside the control of Cavalier Cruises/Sunshine Coast Afloat, is NOT a valid reason for any form of refund. 
  5. All persons booking acknowledge they understand and agree that not sighting any whales, sea-sickness, or a trip shortened in time due to weather or other reason outside the control of Cavalier Cruises/Sunshine Coast Afloat, is NOT a valid reason for any form of refund. Whale Watching tours are based on taking passengers to suitable and likely whale watching locations, and indeed searching for the whales whilst out traversing from one such location to another location, supplying crew for the operation of the vessel and the use of a well maintained safe vessel for the purpose of conducting the tour. The actual sighting of whales on the day is NOT under the control of Cavalier Cruises/Sunshine Coast Afloat and not a reason to request refunds, free trips or discounts.
  6. A discount may be considered for trips shortened in time by more than 2hrs or 20% of it’s expected duration (whichever the greater) due to circumstances outside of the control of Cavalier Cruises/Sunshine Coast Afloat and it’s passengers. The decision for such a discount and the method of payment is at the sole discretion of Cavalier Cruises/Sunshine Coast Afloat.
  7. Refunds will not be considered under any circumstance for passengers having missed their tour departure time due to traffic, over-sleeping, sudden illness on-set or other reasons creating a “No Show” situation on the day of departure. This includes any tour booked via a 3rd party or agent.

7. TERMS SPECIFIC TO WHALE WATCHING CHARTERS:

  1. Whale Watching is not recommended for children under the age of 3 years and is an open ocean water activity.
    1. Cavalier Cruises/Sunshine Coast Afloat does not carry or supply life jackets or life bassinets  for children under the age of 3. If customers wish to bring along children under 3 years of age they MUST supply their own PFD (Personal Floatation Device) suitable for that child. Cavalier Cruises/Sunshine Coast Afloat staff will require inspection of the PDF prior to boarding. Non conformance by the passenger(s) will result in them not being permitted to board the vessel and partake in the tour. No refunds are applicable in such circumstances.
  2. Whilst Cavalier Cruises/Sunshine Coast Afloat make every effort to ensure whales are sighted on your charter, should a whale not be sighted on your tour, discounts or repeat trips are not automatically applicable.  Such offerings are considered on a case by case situation by the management of Cavalier Cruises/Sunshine Coast Afloat and will be offered on the day upon return if applicable.
  3. Refunds are never applicable, available or offered for a whale watching trip that did not sight whales. Refer to items 6.6 and 7.2 of these terms and conditions.
  4. If using a free trip due to the situation in item 7.2 above, and the same situation occurs again, no additional free or discounted trip will be applicable.

8. GIFT VOUCHERS/CERTIFICATES:

  1. Gift vouchers are NOT refundable once purchased.
  2. Standard, non promotional, gift vouchers are valid for 3 years from the date of purchase. The exact expiry date is shown on your gift voucher. Once a voucher has expired, it is no longer valid. Unused vouchers at the date of expiry will not be refunded and will become the property of Cavalier Cruises/Sunshine Coast Afloat. Extensions are only given once an additional fee has been paid to extend the voucher – Maximum of 3 months given.
  3. If a product price has increased, and the user wishes to use the voucher for the activity stated on the voucher, the user will be required to pay the difference at the time of booking the experience to be able to utilise the voucher. The user can if possible utilise the voucher for an alternative activity of lesser value should they wish. No refund of the difference is applicable in such circumstances.
  4. Non-standard gift vouchers are valid for either 3 or 6 months. Non Standard gift vouchers may be supplied by Cavalier Cruises/Sunshine Coast Afloat for promotions, prizes and other reasons at the sole discretion of the company. Non-standard gift vouchers cannot be purchased by individuals. The exact expiry date is shown on the gift voucher. Once a voucher has reached the expiry date it is no longer valid nor redeemable. Unused vouchers at or after the date of expiry will not be refunded and will become the property of Cavalier Cruises/Sunshine Coast Afloat. Extensions on non-standard gift vouchers will not be given, under any circumstance. If a non-standard gift voucher is for more than one person such a voucher cannot be used on separate dates. Regardless of the number of people able to use the voucher at the given time, the voucher can in total only be used on a single occasion. Once used to secure a booking, gift vouchers are treated as a standard booking. This means that ‘no shows’ incur a 100% cancellation fee, which in reality voids the Gift Voucher making any further bookings on the voucher impossible.
  5. Cavalier Cruises/Sunshine Coast Afloat reserves the right to cancel or void your gift certificate if you make a booking and do not show up, or show up late. This is inclusive of same day bookings (ie. those made on the same day as departure).
  6. Any discussions relating to any financial aspect will only be had with the person purchasing and paying for the gift voucher. Individuals who have been provided such a gift voucher have no status financially with Cavalier Cruises/Sunshine Coast Afloat as we have no record of financial dealings with anyone other than the purchaser of the voucher.
  7. Gift vouchers may be transferred to another person provided Cavalier Cruises/Sunshine Coast Afloat is informed of and agrees to such transfer by the person named on the voucher. All normal terms and conditions outlined by Cavalier Cruises/Sunshine Coast Afloat apply equally to gift vouchers unless clearly stated differently.

9. PRIVACY POLICY:

  1. In Australia, your privacy is protected under law by the Privacy Act 1988 (Cth) and this policy which sets out how we manage your personal information to protect your privacy.
  2. We do not collect personal information unless it is necessary for providing our services. We collect, use and store your personal information so that we can provide you with the service you requested. This includes managing your personal information for verifying your identity, preventing fraud and processing your requested sales transaction. We will only use your personal information for the purpose for which it was collected and any related purpose such as improving our services.
    This includes marketing and internal quality control. We will not disclose your personal information to anyone without your consent unless required to do so by law or for providing our services or related purposes. The type of personal information we collect may include your name, address, phone number, email and credit card details.
  3. We protect your collected personal information from abuse, loss or unauthorised access. When you make a payment through our web site your personal and financial details are protected. Your personal information is stored securely on paper or electronically. We do not store your credit card details on our servers.
    We use passwords, firewalls, secure certificates, data encryption and 128 bit secure server technology. We also require our employees and contractors to maintain confidentiality.
  4. You may contact us anytime to gain access to your personal information. We may refuse access under limited circumstances prescribed by law. This includes refusing access if it would pose a serious threat to the life or health of any person or access would unreasonably impact the privacy of others. We collect, use and store personal information that is as accurate and current as possible. Please contact us if you believe your personal information is inaccurate or incomplete.

10. COVID-19 POLICY:

Cavalier Cruises/Sunshine Coast Afloat Operate In Accordance With All Qld And Federal Health Regulations And Requirements.

  1.   2. Given the rapidly changing circumstances related to the covid-19 pandemic and it’s impacts on all businesses, but in particular the tourism industry, Sunshine Coast Afloat is obligated to adhere to the recommendations of all relevant legal authorities and as such can only operate when it has been authorised to do so by such authorities.
  3. All bookings made for the period affected by the Covid-19 pandemic are placed “on Hold” by Cavalier Cruises/Sunshine Coast Afloat, with rebookings to take place once normal operations are again permitted. Fully Paid Booking (not deposit only) will be able to rebook any time WITHOUT incurring any impacts of possible increases in booking rates.
  4. For any customers that may not have a clear idea of when they will be able to rebook their activity, Cavalier Cruises/Sunshine Coast Afloat can provide a voucher to the equivalent value of the amount paid. To further assist our customers such vouchers will NOT HAVE AN EXPIRY DATE, to ensure the value remains available to the person named on the voucher until such time as it is able to be utilised by them.
  5. Refunds will only be available to those customers impacted by the Covid regulations on the Sunshine Coast. Interstate Covid situations are not considered a valid reason for a refund request. If a cancelation made for reason that relate to a Covid situation in another state (including those that are based on possible covid situations in any location) and are not within the normal cancelation periods as per these terms and conditions, will not be approved for  refund. 
  6. The vouchers as mentioned in point 4 above will not be issued automatically but only on request by the relevant customer. Vouchers can only be made out to the person that has paid funds to Cavalier Cruises/Sunshine Coast Afloat.
  7. Cavalier Cruises/Sunshine Coast Afloat reserves the right to not accept bookings from interstate customers if the possibility exists that such booking may not proceed due to potential Covid related impacts.
